“Go on,” I prompt, starting to feel a bit giddy.
“If Paul is grossly insubordinate to a superior or board member, he can be dismissed.”
“Dismissed is one thing, but can he take his intellectual property with him.”
“The simple answer is no. He forfeits his right. My guess is that Mr. Butler wanted some type of control against Paul’s diva behavior. It would allow him to push back in case of differing opinions. It’s a gray area, but it’s good enough to get rid of the guy and be sure that he can’t take his software with him. I can guarantee that he will try to sue you, but I doubt he will win. Are you willing to take that chance?”
“I am, and he already has a nasty record with me. Since I’m an owner, I also count as a superior.”
“Did you document all the instances of his behavior?”
“No. Is that a problem?”
“It could be. Did you have witnesses to any of the incidents?”
“Today, two of the supervisors were there, but they didn’t hear the worst of it because I asked them to leave. However, Paul was insubordinate in front of them.”
“For now on, document everything, even the small stuff. The more ammunition you have, the better. You should also consider having a conversation with Mr. Butler. I’ve had enough experience to know that things like this can turn into a huge disaster if everyone isn’t on board.”
“That’s a touchy subject, but I will talk with him. After today, I’m on his shit list, but we’ve been friends for a long time, so it should pass. I hope.”
“Good luck, and let me know if you need anything.”
